Notice about Printing and Circulating Provisional Measures for Consumer Access Management in Shandong Province Major Consumer Direct Power Purchase Pilot
To: Economy and Information Technology Commissions of the Cities in Shandong (Economic and Trade Commission and Economic Commission):
We have formulated Provisional Measures for Consumer Access Management in Shandong Province Major Consumer Direct Power Purchase Pilot in accordance with Notice about Relevant Problems with Perfecting Power Consumer/Power Generation Enterprise Direct Trading Pilot (DJSC Doc. No. 20) and People’s Government of Shandong Province’s Letter about Submitting Shandong Province Major Consumer Direct Power Purchase Implementing Scheme (LZZ Doc. No. 176 (2009). The Measures aims to promote major consumer direct power purchase pilot work, fully allow market access to guide the industry, boost economic transformation and restructuring in Shandong Province, and speed up industrial adjustment and rejuvenation in the province. The Measures is now printed and circulated for you to follow and implement.

Provisional Measures for Consumer Access Management in Shandong Province Major Consumer Direct Power Purchase Pilot
1 The Measures is formulated in accordance with Notice about Relevant Problems with Perfecting Power Consumer/Power Generation Enterprise Direct Trading Pilot (DJSC Doc. No. 20) and People’s Government of Shandong Province’s Letter about Submitting Shandong Province Major Consumer Direct Power Purchase Implementing Scheme (LZZ Doc. No. 176 (2009). The Measures aims to promote the major consumer direct power purchase pilot, standardize management procedures, and rigorously implement access standards.
2 Market access will play an important role in guiding the industry and boosting economic transformation and restructuring in Shandong Province. State Council Notice on Further Strengthening Elimination of Outdated Capacity (GF Doc. No. 7 (2010) shall be strictly implemented with a view to boosting industrial restructuring, technological advancement, and optimal upgrade, and speeding up industrial rejuvenation.
3 Shandong Economy and Information Technology Commission is responsible for consumer access management for the major consumer direct power purchase pilot in the whole province, while its branches in the cities are responsible for the preliminary review and routine management of local pilot consumers.
4 The Measures is applicable to all major power consumers in Shandong Province.
5 An economic entity with a legal person status that has independent accounting (a major consumer with internal accounting shall be authorized by an institution with a legal person status) and good credit.
6 A power consumer that complies with power consumption management rules of the state and consumes power at a voltage of 110kW or above.
7 An enterprise whose investment project approval (filed), land use, environment evaluation, and energy-efficiency appraisal comply with relevant state rules.
8 An enterprise whose production is within the scope of industries encouraged by the state and local governments as specified in the Guiding Catalog for Industrial Restructuring (2005 Edition), National Development and Reform Commission Directive No. 40, and Shandong Province Guiding Catalog for Industrial Restructuring in High Power Consumption Industries (LZBF Doc. No. 59 (2007). It does not develop any project as limited in the guiding catalogs and does not the outdated process, technology, equipment, and products labeled to be eliminated.
9 An entity that meets the industry access requirements as specified by the state. In an industry for which relevant authorities have published industry access requirements, the entity shall meet the relevant industry access requirements in such criteria as process, technology, equipment, scale, and power consumption. In an industry where a list of enterprises eligible for access has been published, the entity shall be on the list.
10 An entity that meets the requirements in Opinion of the People’s Government of Shandong Province and CPC Shandong Committee about Speeding Up Industrial Adjustment and Rejuvenation (LF Doc. No. 9 (2009)) and relevant industry adjustment and rejuvenation plans and guidelines, and helps to boost such industrial adjustment and rejuvenation; an entity with a support project listed in an industrial adjustment and rejuvenation plan will receive preferential support.
11 An enterprise whose comprehensive product power consumption is better than the local standard of Shandong Province for the per-unit industrial product power consumption. An enterprise with a key national-level or provincial-level energy-efficiency project will be preferred.
12 An enterprise that discontinues its autonomous generator unit according to the policy “Major Power Plants Encouraged and Small Ones Discouraged” in order to promote the restructuring effort in the power industry in Shandong Province.
13 The access qualification requirements as specified in the Measures are subject to timely adjustment with the changes to relevant policies of the state and the province.
14 Any applicant seeking inclusion in this pilot shall make the application on a voluntary basis. The application shall include:
1) Corporate fundamentals, mainly operating indicators such as products and current production capacity, production volume, sales volume, profit, and tax;
2) Indicators such as process, technology, equipment, scale, energy consumption, environmental production, and work safety;
3) Basics of power consumption in the previous year (voltage level, load, load rate, and volume of power consumed), nature of the power supply area where it is based (direct supply area/bulk sales area), power price, expenditure on power in the whole year and its percentage of the product costs, and any increase in power consumption in the year (if any);
4) Whether it owns an autonomous generator unit and the status of power generation;
5) Comprehensive per-unit energy consumption involving main products in the previous year.
15 The applicant shall submit the following materials at the same time:
1) A copy of the business license issued by the Administration of Industry and Commerce;
2) Copies of documents for the approval or filing of a project underway, land use, environmental appraisal, and energy-efficiency appraisal, while those involving additional production capacity shall be described in particular;
3) Copies of relevant documents that can prove the advancement of its process and technology comparative to its industry peers;
4) The corporate representative of the applicant shall provide a statement guaranteeing the truth of the information in the application and the materials submitted.
16 A consumer interested in applying for inclusion in the pilot may submit an application in writing to the local Economy and Information Technology Commission and submit the required application materials
17 The local Economy and Information Technology Commission conducts a preliminary review of the applicant. If the application passes the preliminary review, the Commission shall issue its opinion for the review and submit it, together with the application materials of the applicant, to Shandong Economy and Information Technology Commission.
18 If the application passes the review of Shandong Economy and Information Technology Commission, the applicant shall be published for two weeks at http://www.sdeic.gov.cn.
19 If there is no challenge to the applicant during the publishing period, the applicant shall be qualified as a consumer for the major consumer direct power purchase pilot and listed in the backup library of consumers for the Shandong major consumer direct power purchase pilot.
20 Shandong Economy and Information Technology Commission shall select a pilot consumer from the backup library of consumers for the Shandong major consumer direct power purchase pilot in accordance with the work priority of the state or Shandong Province in industrial restructuring in a certain period, the status of the balance between power demand and supply, and the progress of the direct power purchase pilot.
21 The status report mechanism is implemented for the major consumer direct power purchase pilot. A pilot consumer shall report its business operations and relevant indicator attainment. A power generation enterprise shall regularly communicate the execution, settlements, etc. of its direct power purchase on such platforms as the power trading information press conference.
22 Shandong Economy and Information Technology Commission conducts an annual review of relevant indicator fulfillment by a consumer in the direct power purchase pilot. The Commission shall disqualify the major consumer as a pilot consumer if:
1) It no longer meets the access qualification requirements due to changes in its production indicators; or
2) Its process or products are listed as limited or eliminated or its relevant indicators exceed those specified in policy after relevant state or provincial industry policies have changed; or
3) It has been proved that the pilot consumer falsified its application or showed malpractice when it was a pilot consumer.
23 If the pilot consumer challenges the decision on its disqualification, it may appeal or complain to Shandong Economy and Information Technology Commission, which shall make a reply after verification.
24 The Measures is subject to the interpretation by Shandong Economy and Information Technology Commission.
25 The Measures comes into effect as of its publishing.
